Prophet Paseka Motsoeneng, commonly known as Mboro, says he wants R11 million from an organisation that expelled his church by the name of Incredible Happenings in 2016. The trial between the church leader and Metcash Trading Limited and Franjeron Pty Limited because of the lease acknowledgement began on Monday. The court proceeds are taking place at the South Gauteng High Court.
The church was taken out of the organisation’s building in Wadeville in Germiston. The church was leasing from Metcash Trading Limited, the bulding is owned by Franjeron Pty Limited. According to a court report from2016, the church was supposed to have left the building on the 30th of August 2016. Wilson Mose Mkhwana, Mboro’s pastor, told publication ‘The Star’ that there was an excess acknowledgement between Metcash Trading Limited and the ministry. The lawyer said that when Metcash Trading Limited spoke to the pastor, they let him know that they are renting the building to him.
“After that they said they would sell shares to him and they promised that they would rezone the property so that it can become a church but all those things were never done,” says Wilson Mose Mkwhana. Mboro says the acknowledgement was a lease-to-buy for R14 million, which he had already contributed R11 million towards. The pastor says he now wants his R11 million back. The lawyer went on to say that the excess acknowledgement had issues of its own, which will be revealed as the case goes.
In the court proceeding the judge, Judge Bashier Vally, was told that the ministry lodged a counter suit of R1 million against Metcash Trading Limited on Thursday. The ministry cited that Metcash Trading Limited was a deception. “This suret was demanded by my legal team because the company Metro Cash and Carry was used by Metcash as a surety for the lease and the shares I was buying from Franjeron Pty and the very same deal was not disclosed in the contract. They bring me to court with a lawsuit knowing very well that Metro Cash & Carry did not exist. Even their lawyers withdrew when they discovered this fraud,” says Mboro.
Lionel Dos Possos, Metcash Trading Limited’s attorney, says the counter lawsuit was used to delay the issue. “Their failure to comply with your Lordship’s directive, no witness statements have been filed and now there is an addendum before your Lordship caused by leaving things to the last minute,” says the Metcash Trading Limited attorney. The issue was postponed in order to let Metcash Trading Limited to reply to the lawsuit against them by Mboro. The ministry leader spoke outside of court saying he will keep on saving lives even with the tricks that are conducted by “evil forces.”
