The constitutional court has endorsed the 2017 South Gauteng High Court ruling against corporal punishment at home. The court knocked down the defence of reasonable disclipline. The court says that hitting children infringes the rights of the children.
The Freedom of Religion South Africa debated the Constitutional Court’s outcome. The organisation says that even though it does not encourage assault, family members should be allowed to raise their children according to their religions. The court banned corporal punishment in detention facilities by 1995 and in educational institution by 2002. The current ban of corporal punishment in homes was largely agreed upon. Some tweeps hilariously reacted to the ruling. One tweep says he kicked out his daughter because of the ruling. The tweep says, “Spanking is no longer allowed in South Africa so I have just kicked out my daughter. I told her to stay at the Constitutional Court.”
